The terms and conditions included on this website form the basis of the contractual relationship between Dawn Express (WA) Pty Ltd hereafter called Dawn Express Vacations and it’s clients. It is important that you, the client, are fully aware of these terms and conditions before you make your holiday booking.

1. AGENCY
Dawn Express Vacations will make all the bookings and travel arrangements on your behalf based on the understanding that Dawn Express Vacations is not liable for any act, commission, or default on the part of its servants, agents of the contractors.

2. DEPOSIT AND PAYMENT
A deposit of $100 per person is payable within 7 days upon confirmation of a booking. Failure to receive deposit/balance by due date will mean automatic cancellation. The balance of monies is due 45 days prior to departure. Inside 45 days, the full payment is required upon confirmation.

3. REFUNDS AND CANCELLATION
More than 45 days prior to departure: a fee of $100 per person will be charge, in addition, any airfare cancellation penalties on issued tickets. Less than 45 days prior to departure: a fee of $100 per person will be charged, in addition to, any fees levied by suppliers and your travel agent, including all airfare cancellation penalties and up to 100% of any tour or component cost will apply. After travel has commenced: Unused services cannot be refunded or exchanged.

4. AMENDMENTS TO YOUR HOLIDAY ARRANGEMENTS
Should changes be required prior to documents being issued on a confirmed booking, one amendment is allowed at no additional charge. Subsequent amendments are subject to an ‘amendment fee’ of $35 per change per booking.

5. SERVICE CHARGE
A service charge of A$35 plus GST per booking will apply to any land only booking for less than 3 nights accommodation consecutively at the same hotel or any booking departure inside 10 days. If necessary courier fees will also be charged.

6. CANCELLATION/NO SHOW: HOTEL BOOKING
a) For no-show bookings, to the value of one night’s accommodation and any relevant land or tour portion will be forfeited.
b) Up to 21 days prior to arrival date, a fee of $35 will be charged.
c) Between 21-7 days prior to arrival date, a fee of $50 will be charged.
d) Within 7 days prior to arrival date the value of one night accommodation will be charged.

7. ROOM BEDDING GUIDE
Prices in this brochure are based on existing bedding in the room. Requests for particular bedding arrangements must be made at the time of booking. eg. twin share - separate beds, or a double bed? All requests are subject to confirmation. Additional rollaway beds can be pre-booked.

8. SINGLE SUPPLEMENT
Single occupancy of a room by choice or circumstance is subject to the room supplement charge and is payable to Dawn Express Vacations.

9. HOTEL LOCATIONS AND MAP
Map is for visual reference only and not drawn to scale.

10. HOTEL CHECK-IN AND LATE CHECK OUT
Hotel check-in time is usually 2.00 p.m. while check-out time is at noon. Early check-in can be made upon request and subject to hotel final confirmation which may incur an additional cost. A late check out or day use can be arranged at half rate as per request. Late check out time is normally until 6.00 p.m. Otherwise full night’s rate will incur and payable directly to hotel.

11. DOCUMENTATION
Vouchers will be issued upon full payment received by Dawn Express Vacations. In case of cancellation, the documents issued must be returned to Dawn Express Vacations for immediate process of refund. Otherwise refund can only be processed 30 days after completion of travel arrangements.

12. ALTERATIONS OF PRICES OR ITINERARY
Itineraries and/or prices in this brochure are subject to change as a result of airline rescheduling, fare increases, currency fluctuations,increases in the costs of hotel rates, accommodation, transport and sightseeing tours. The client agrees to pay and/or change the itineraries, such increases or change, notwithstanding the previously advised balance of payment and set of itinerary have been made. Dawn Express Vacations reserves the right to change prices up to and including the date of departure and whether or not full payment for the booking has been received by Dawn Express Vacations. If unforeseen circumstances beyond our control make changes necessary, we reserve the right to cancel or reschedule tour departures and itineraries. Where it is necessary to change a hotel, Dawn Express Vacations reserves the right to substitute accommodation of a similar standard. In peak times some tours may operate in reverse itinerary.

13. EXCLUDED COSTS
The package price excludes items not specifically referred to in the package description/inclusion.

14. INSURANCE
It is strongly recommended that at time of booking your holiday,
travel insurance is purchased to cover against various contingencies such as loss of deposit of fare, loss or damage to baggage, money, travel documents, medical expenses, curtailment charges, personal accident and personal liability.

15. TRAVEL DOCUMENT
All clients must be in possession of a valid passport and necessary visas at the time of commencement of travel. All such
documentation is the client’s responsibility. Your travel agent may assist on request in organising documentation. Dawn Express Vacations accepts no liability or responsibility whatsoever arising from the failure of clients to obtain appropriate documentation. (Client should always have a valid passport and a minimum validity of 6 months or more upon arrival of each of the visiting destinations.)

16. HEALTH REQUIREMENTS
Clients should familiarise themselves with any health requirements applicable to areas they intend to visit. The client is solely responsible for compliance with vaccination and other health requirements of the government in countries visited or transited. The Department of Health or any general medical practitioner will be able to assist with details of current local health requirements.

17. TRAVEL AND ACCOMMODATION
Coach journeys and others forms of transport and hotels accommodation are provided by independent third parties. The standard from time to time may differ from that specified. Dawn Express Vacations has no control over such standards and makes no warranty in the regard. All bookings through Dawn Express Vacations are subject to and other service providers. The client hereby expressly acknowledges and agrees that he or she shall have no claim or cause no action whatsoever against Dawn Express Vacations should any carrier hotelier or others services provider provide services which differ in any way from those specified by Dawn Express Vacations.

18. LIMITATIONS OF RESPONSIBILITY
Dawn Express Vacations acts only as agents for the travel accommodation and other associated services as requested, and all coupons, exchange orders, receipts, or documents, are subject to any or all tariffs, terms and conditions under which any accommodation, transportation or any other services whatsoever are provided by independent third parties. Dawn Express Vacations understands the Booking Conditions described in the brochure have been read, understood and accepted by the client. Dawn Express Vacations and the shareholders, officers, directors, agents, and employees of the company do not accept liability or responsibility whatsoever for any accident, loss, injury, sickness, death, delay, detention, deviation, damage, cancellation, substitutions, other unforeseen event or whether due to it or its servants agents or employees negligence or otherwise arising out of or in connection with any accommodation, transportation or other services, or resulting directly or indirectly from acts of God, dangers, incidents of sea, fire, breakdown in machinery or equipment, acts of
governments or other authorities, de jure or de facto wars, whether declared or not, hostilities, civil disturbance, strikes, riots, thefts, pilferage, epidemics, quarantines, medical or customs regulations, delays or cancellations of or changes in schedules or itinerary, or overbookings or defaults, or from any causes beyond Dawn Express Vacations’s control or through the acts or defaults of the airlines, hotels, car companies or coach, railroad, steamship lines or owners or contractors providing accommodation, transportation or other services for any loss or damage resulting from improper or insufficient passport, visas or other documents and that neither Dawn Express Vacations nor its servants agents or employees shall be or become liable or responsible for any additional expense or liability sustained or incurred by the passenger as a result of any of the foregoing causes. Every endeavour has been made to ensure that contents of this brochure are accurate at the time of printing, however, changes may occur without notice, but Dawn Express Vacations shall not be under any obligation or be liable to any person for any inaccuracy or misdescription contained herein or which implied by the contents of this brochure or any arising out of the provision of failure to provide any of the service. Payment of money due to Dawn Express Vacations, must be made through a Travel Agent who do not receive such money as Agent for Dawn Express Vacations bears no responsibility for same until actually received from the Travel Agent.

19. LAW BY CONTRACT
Subject to any contractual terms which may be implied by statute and cannot be excluded, these Conditions are to be the sole determinant of the rights, duties, responsibilites, obligations and liabilities as between each passenger and Dawn Express Vacations. These Terms and Conditions are construed in accordance with the Laws of the State of Western Australia and the passengers hereby agrees that any legal action commenced against Dawn Express Vacations whether for breach of these conditions or otherwise, shall be brought in court of competent jurisdiction within that State.

20. CONSUMER CLAIMS
Should be lodged in writing to your Travel Agent within 30 days of return to Australia with supporting document. Claims would not be entertained afterwards.

21. AIRLINES
The airlines utilised in this brochure do not by virtue of their endorsement of this brochure represent themselves as either contracting with any purchaser of a Dawn Express Vacations
holiday or as having any other legal relationship with any such purchaser.
